PRIVACY POLICY

Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), Promitel limited liability company limited partnership with its registered office in Chorzów informs:

1. The Controller of your personal data is Promitel limited liability company limited partnership with its registered office at: ul. Katowicka 16b, 41-500 Chorzów.

2. Your personal data will be processed for the purpose of: concluding and/or performing a contract/order, as well as sending marketing information (including newsletter) from Promitel sp. z o.o. sp. k.

3. The processing of the provided data: is necessary for the performance of a contract to which the data subject is a party (Article 6(1)(b) GDPR), is necessary for compliance with a legal obligation to which the controller is subject (Article 6(1)(c) GDPR – VAT taxpayer obligations), and will also be carried out on your consent to the processing of personal data (Article 6(1)(a) GDPR).

4. The provision of data as required by VAT regulations is mandatory and is a condition for concluding the contract. Other data are processed with your consent to processing (Article 6(1)(a) GDPR) and are also a condition for concluding or further performance of the contract. The data subject is obliged to provide the data, and the consequence of not providing the data will be the inability to conclude or further perform the concluded contract.

5. Data will be made available to the following categories of data recipients (external entities):
a. professional entities providing accounting services, in order to fulfill tax obligations incumbent on us as an employer.
b. professional entities providing legal services, in order to fulfill legal obligations arising from the contract binding us.
c. professional entities providing IT services, in order to fulfill obligations related to IT security.
d. contractors for the purposes of concluding and performing contracts, to the extent falling within your contractual obligations.

6. Your personal data will not be transferred to third countries.

7. Your data will not be subject to any automated decision-making, including profiling, referred to in Article 22(1) and (4) GDPR.

8. Data will be stored for a period of: 6 months from the date of response to the submitted request for proposal if no contract has been concluded; if a contract has been concluded, for the duration of the contract, and also for the limitation period of civil law claims arising from that contract, i.e. 3 years from the date on which the contract was terminated or expired, taking into account the expiry of warranty/guarantee periods.

9. You have the right to access your data and the right to rectify, erase, restrict processing, the right to object to processing, as well as the right to data portability.

10. You have the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

11. You have the right to lodge a complaint with the President of the Personal Data Protection Office if you consider that the processing of your personal data violates the provisions of the GDPR.

NEWSLETTER – GDPR INFORMATION CLAUSE

Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), Promitel limited liability company limited partnership with its registered office in Chorzów informs:

1. The Controller of your personal data is Promitel limited liability company limited partnership with its registered office at: ul. Katowicka 16b, 41-500 Chorzów.

2. Your data will be processed for the purpose of:

a) provision by the Controller of an electronic service within the meaning of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219, as amended), consisting of sending a newsletter by the Controller – on the basis of separately given consent (Article 6(1)(a) GDPR),

b) carrying out direct marketing – on the basis of Article 6(1)(f) GDPR,
c) carrying out marketing and promotional activities – on the basis of separately given consent (Article 6(1)(a) GDPR),
d) sending commercial information by electronic means in accordance with Article 10(2) of the Act on the provision of electronic services of 18 July 2002 (Journal of Laws of 2017, item 1219, as amended) – on the basis of separately given consent,
using telecommunications terminal equipment and automated calling systems for direct marketing purposes in accordance with Article 172 of the Act of 16 July 2004 – Telecommunications Law (Journal of Laws of 2017, item 1907, as amended) – on the basis of given consent;

3. personal data will not be transferred to other recipients;

4. Your personal data will be processed until the consent given is withdrawn or an objection is lodged against data processing (which will also occur as a result of termination of the contract for the provision of electronic services consisting of sending the newsletter) – in cases where your personal data are processed on the basis of separate consent for sending the newsletter or for marketing activities or on the basis referred to in Article 6(1)(e) or (f) GDPR, including for direct marketing purposes;


5. Providing your personal data is voluntary, but required to receive the newsletter, and failure to provide the data will result in the inability to receive the newsletter from the Controller;

6. The Controller does not process your personal data using tools for automated decision-making, including profiling;


7. You have the right to request from the Controller access to your personal data, their rectification, erasure, restriction of processing or their portability;


8. You have the right to object to the processing of your data, as well as the right to withdraw your consent at any time, whereby withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal;


9. If you consider that the processing of personal data by the Controller violates the provisions of the GDPR, you have the right to lodge a complaint with the supervisory authority (i.e. the President of the Personal Data Protection Office).

 

PASSWORD RESET REGULATIONS FOR HIKVISION DEVICES

1. Promitel Sp. z o.o. sp. k. with its registered office at ul. Katowicka 16b, 41-500 Chorzów, hereinafter referred to as the Service Provider, provides the service of administrator password reset for Hikvision devices.

2. The Service Provider undertakes to review and reset the password in Hikvision devices on the basis of a completed form on the website reset.promitel.pl by a person hereinafter referred to as the Applicant. The service is provided only on business days, and the service delivery time may be up to 24 hours.

3. The Service Provider reserves the right not to consider data sent for password reset in any other way than described on the website reset.promitel.pl and through that website.

4. The Service Provider reserves the right not to meet the password reset deadline in the event of legal restrictions or other unforeseen circumstances, including deadlines of external services, as well as changes in the policy and conditions set by the Manufacturer.

5. The Service Provider is not liable for the consequences of the performed reset procedure. The above notification does not include the right to claim compensation for lost benefits in connection with the password reset, in particular does not include compensation for loss of time, temporary inability to use the product, inconvenience and related warranty claims, inconveniences or costs. The Service Provider is not liable for damages caused by the person performing the password reset on the Applicant’s side.

6. The Applicant assumes full responsibility for the entrusted data resulting from obtaining access to devices with administrator rights, including sensitive data as understood within the provisions of the GDPR.

7. As a rule, the Service Provider performs password reset on Hikvision devices free of charge, as part of the warranty, however, reserves the right to charge the Applicant for the costs of performing the password reset service specified in the service price list included in the service request regulations available at Regulations .

COOKIES POLICY

  1. The Service does not automatically collect any information, except for the information contained in cookies.
  2. Cookies are IT data, in particular text files, which are stored in the User’s end device of promitel.pl and subdomains collectively referred to as the Service, and are intended for the use of the Service’s websites. Cookies usually contain the name of the website they come from, the time they are stored on the end device, and a unique number.
  3. The entity placing cookies on the User’s end device of the Service and accessing them is the operator of the Service Promitel Sp. z o.o. Sp. k. with its registered office in Chorzów, according to the data in the Contact tab.
  4. Cookies are used for the following purposes:
  • adjusting the content of the Service’s websites to the User’s preferences and optimizing the use of websites; in particular, these files allow to recognize the User’s device of the Service and properly display the website, tailored to his individual needs;
  • creating statistics that help to understand how Users of the Service use websites, which allows improving their structure and content;
  • maintaining the User’s session of the Service (after logging in), thanks to which the User does not have to re-enter login and password on each subpage of the Service;
  1. Within the Service, two basic types of cookies are used: “session” cookies and “persistent” cookies. “Session” cookies are temporary files that are stored in the User’s end device until logging out, leaving the website or turning off the software (web browser). “Persistent” cookies are stored in the User’s end device for the time specified in the parameters of the cookies or until they are deleted by the User.
  2. Within the Service, the following types of cookies are used:
  • “necessary” cookies, enabling the use of services available within the Service, e.g. authentication cookies used for services requiring authentication within the Service;
  • cookies used to ensure security, e.g. used to detect abuse in the field of authentication within the Service;
  • “performance” cookies, enabling the collection of information on how the Service’s websites are used;
  • “functional” cookies, enabling “remembering” the User’s selected settings and personalization of the User’s interface, e.g. in terms of the selected language or region the User comes from, font size, website appearance, etc.;
  • “advertising” cookies, enabling the delivery of advertising content more tailored to the User’s interests.
  1. In many cases, the software used for browsing websites (web browser) by default allows the storage of cookies on the User’s end device. Users of the Service may change the settings concerning cookies at any time. These settings can be changed in particular so as to block the automatic handling of cookies in the web browser settings or inform about their placement in the User’s device each time. Detailed information on the possibilities and methods of handling cookies is available in the software (web browser) settings.
  2. The Service Operator informs that restrictions on the use of cookies may affect some of the functionalities available on the Service’s websites.
  3. Cookies placed on the User’s end device of the Service may also be used by advertisers and partners cooperating with the Service operator.
